just been to halfords with my 510 that only powers up when it feels like it & manager says they cannot refund its in their policy,so i say what do i do with sat-nav what doe'nt work he says leave it with them to look at monday,so i said i'm not happy with the product & insist on refund but wont give me refund so i'll be on fone to citizens advice monday see what they say.

The Sale of Goods Act is now Statutory Instrument 2002 No. 3045
The Sale and Supply of Goods to Consumers Regulations 2002

Basically, you're contract is with the seller i.e. Halfords.

Goods must be of merchantible quality and fit for their purpose. You can ask (demand) a full refund or if you prefer ask for a replacement or repair.

The manager in refusing to give you a refund is breaking the law.

Also did you pay by credit card? If so the card company are jointly liable with Halfords.

Write to the company (recorded delivery) telling them that you are rejecting the goods because they are not of satisfactory quality and that you hold them jointly liable under Section 74 of the Consumer Credit Act 1973. Tell them you want an immediate refund.

That is why I always try to use a credit card for all purchases - but remember it only applies if the total cost is over £100. You need only need use the card for a small deposit, as long as some part of the purchase price has been paid with it. That why I put credit card deposit down on last two cars I bought.

Especially useful if the supplier goes bust on you and works for services such as holidays too. Also recent court case confirmed that it also applies to purchases made abroad.

been in touch with citizens advice today they told me to write to halfrauds head office + get credit card company to pursue it.& yes they are breaking the law.

They are not strictly "breaking the law". They are in breach of an implied term of the contract you have with them, but that is not the same.

If you do not hear back from the letter you wrote to the CC or main office then i would go back in and ask to speak to the manager again, advise him that you are in breach of contract and you will be proceeding with a getting a CCJ. If he does not react to that then he is either too stupid or does not care.

Unusual attitude for Halfords - a friend of mine used to work at a Halfords superstore and they were told to do pretty much anything to keep the customer happy. This even extended to refunds on stuff like cans of oil that the customer had clearly bought somewhere else. Times must change - or perhaps they got taken advantage of.

i phoned manager at halfrauds today & asked for head office address & told him i'd been in touch with citizens advice & all i got out off him was they don't know the law so you could be right steven he could be stupid.

Copy the following and paste it in MS Word, or whatever you use, fill in the necessary details, print it and take it to the Manager of the shop.

I'm tempted to recommend you start with Dear Mr. Stupid :P

The fact that the (item) showed these defect(s) within (the time) of purchase shows that it was faulty when I bought it. You are therefore in breach of contract and I may reject the (item) and claim a refund of the full purchase price of (£..........) from you.

I look forward to receiving this sum by (give a date). If you fail to reimburse me I shall have no alternative but to consider issuing a summons against you in the county court for the recovery of the money.
