mio 338 probs

Hi peeps anyone help me out here ? i've got a mio 338 digiwalker i 've loaded tomtom 3 on it + gps ,pio's but it freezes after a while & i have to reset it but it still does not work then all of a sudden its comes on ? is it the software or gps unit as it's only a week old (gps unit) p.s i did have a ipaq 3630 with same software on it that was ok but a bit bulky with compact flash sleeve on it :D
