I thought the POI.dat was copyright (TomTom), therefore it should not be modified.

It gets modified every time you download Mapshare POI updates, or make changes to POI's via the change options.

Ok let me explain:

I was under the impression that disassembling and adding your POI to tomtom POI.dat was an infringement of the copyright. Which I suppose many members beleive it as well, as I have been told on this site that is copyrighted.
Deleteing tomtom POI.dat (from you device) and creating your "own" without the use of any tomtom poi is ok.

If not I'll stand corrected Wink

I think poi.dat stays as is, and the new data is appended.

Hi Magdy, first let me make it clear that I'm not having a go at you. Laughing

If something is copyrighted, and one add and corrects, by definition one is altering the database contents, therefore breaching copyright.

This is the same argument we had about the PGPSW database. Even though the coordinates, the cameras etc. etc dont belong to PGPSW they still have the copyright because they have assembled the database.

That is neither factually not legally accurate. It is a complicated topic and this is not the place to debate it but an individual or company can claim ownership of a collective work. It may not have copyright over the actual data but their rights do extend to preventing others from using that data in its compiled form or to prevent it from being extracted and used.

If we take the phone book as a case in point, whilst any company can go out and collect their own data they cannot copy the phone book and use it for their own ends without paying BT for the privilege and rest assured, electronic access to the phone directory is very expensive. In the case of the poi.dat file even the simple act of disassembling such a work could be construed as a breach of their rights.

No-one is suggesting that a location can be copyrighted but where a company has invested money in collecting location data, the resulting database can be protected legally.

I am not going to comment on the copyright issue, but read the EULA that came with your device and part of it says ''Thou shall not de-compile the software / files etc'' so this is dubious but at the same very interesting as it provides a second method to add good data from reliable sources to the poor data supplied with the device - Mike
