I'm sure TT would have a 'reasonable defence' that the problems with the 1000 models are explained elsewhere on the site. |

I'm sure it would take less time to remove the 'misleading or false content' than it will to bring the 1000 up to it's advertised specification, which could well be never if past experience is anything to go by!! |

Would the ASA cover Dutch companies?

Just vote with your wallet and ditch Tomtom.
It's not like they're the BBC or something, with a gun to your head to give them your money. |

but they don't operate *FROM* the UK. I honestly doubt they would fall foul of the ASA.
And, while we're at it, just what HAS swimming got to do with TomTom's marketing?!

MaFt is correct:
ASA CAP Code wrote: |
The CAP Code code does not apply to marketing communications in foreign media. Direct marketing communications that originate outside the United Kingdom and sales promotions and advertisements in paid-for space that are published on non-UK-registered websites, if targeted at UK consumers, are subject to the jurisdiction of the relevant authority in the country from which they originate |
Ref: ASA
I don't know anything about the TomTom 1000 series, but generally speaking, if a consumer buys goods which are not "as described" then they have a right to claim a refund/compensation/remedy from the supplier under existing consumer laws which are similar in all EU countries and that is the best line to take. _________________ Gone fishing! |

I bought the Via 120 Live Europe, and it has the same problems, but I took it back after 2 weeks and got a refund, as the item bought was not fit for purpose.
It might be worth letting you know that the OFT have had thousands of complaints from customers, and they recommend taking them back.
I did and I bought a Garmin, I will never buy another Tomtom ever. |

I would agree - also I believe that 'fit for purpose', etc is covered under the various 'Trade Description' acts, and as such, the remedies are against the supplier, such as Halford's, rather than the manufacturer. I think even if it's an internet dealer supplying into the UK there is similar protection (but possibly more difficult from a practical point of view). _________________ David

Dunno, I sometimes find it easier to email a company, get a returns code and walk to the post office to return it. Compare that to driving into town, paying £3 to park for an hour, taking it into the shop, getting past the spotty kid from The Simpsons only to be faced with the pathetic Gil from The Simpsons who tries to persuade you that you want to buy something else and that you're making life really hard for him having to return it and he'll end up loasing his job as the shop will be losing money. Eventually after saying the magic words "Trade", "Descriptions" and "Act" you manage to get a refund but they make you feel like they're being generous to you, you're not legally entitled to it and that you're THE most awkward customer they've ever had to deal with.
Wooh, glad I got that out of my system!

You know 'H' then MaFt? Certainly sounds like you went to our Hertford branch (though I find that difficult to believe, as it's nearly as far south as 'Ixeter' and 'Fookston'!).
And Quote: | you're THE most awkward customer they've ever had to deal with. | must be a response they learn in training as they seem to have to use it many times each day. _________________ David
