I am a complete novice to all this and have just ordered a complete kit which includes the tomtom3 car kit and a
mitac mio 338.
I have a few questions (not ever had one before).
Is it easy to set up in the car?
Do you have to pay to use a route?
Can you use it away from the car say for walking?
I've heard that you may need to activate the software is this true?
Any other help would be great

yes

not directly - you will need a different power supply outside the car

-I've heard that you may need to activate the software is this true?
yes this is true, the software can only be installed on one PocketPC. Either your Pocket PC or your PC needs to be online to activate the product.

have you tested the mio with tomtom? getting any satsilites, want to hear everything =)

Mio 338 is no different from any other PPC so it is not necessary to test it specially as far as Tom Tom is concerned.
