Do I contact TomTom, or approach the retailer that I bought it from ?

If its broken because it was defective then I would suggest that your first port of call is the retailer. If you broke it through misuse then it is unlikely that you will get it replaced free of charge.

Its broken where you tighten the screws together to enable fitment to the windscreen to stop it slipping about..wouldnt call that misuse..

Hint:

if you take the mount off the windscreen each time you leave the car, it's a good idea to loosen the screws, or at least the one holding the two main parts of the mount together. If you leave them tightened and then throw the mount into a bag, it's all too easy to put too much strain on the apparatus. Crying or Very sad

Well, I contacted TomTom support by email, told them it was broken, and without delay they have arranged a courier to ship me out a replacement FOC. Should be with me by Monday according to the tracking info they supplied.

With all the bad press that their customer service dept get on this site, I certainly cant fault them on this one.

Nice one TomTom !!
