I bought a S/Hand 3950 which already has TT2 on it, I would like to upgrade it but it will not allow me to due to codes etc. Have askd TT how I can make it legit but they have not answered. I want to stay with V2 but is it still available.

Let me guess, you bought the 3950, with TTNav2 preloaded, off eBay?
If you want to upgrade it you must go to TTNav3. The latest version of the software was TTNav2.24, but the map data never changed from the original issue. To get new maps, you must upgrade to TTNav3.
I think that there are two ways to make your copy of TTNav2 legitimate:
1. Contact the seller and ask for the original install CD and codes, which are on the CD case.
2. Try to locate an unregistered full copy of TTNav2 (probably for the full retail price) and use the codes from the new copy. Failing that you will need to buy a full copy of TTNav3.

As Privateer says, a copy of TomTom Navigator 2 or Navigator 3 is only legitimate if it's supplied with the original CD or CDs (depending on the country version, there may be one or more than one CD - Navigator Great Britain is a single CD) and Product Code label.
If you lack both of these, the chances are your copy of Navigator is not legitimate. Either the seller has installed and activated Navigator using a copy he or she hasn't then transferred to you (this is particularly tempting if they've upgraded their Pocket PC and they're selling the old unit, as all they have to do is leave Navigator installed), or they've got hold of a hacked version with activation disabled (which are reputed to exist).
The only way to regularise the situation is to contact the seller. If he or she will not transfer the Navigator CD and Product Code, or you get a transfer of Navigator 2 and find that the Product Code has already been used to upgrade to Navigator 3 (which is rather sneaky, and arguably a breach of the intention of the upgrade program even if not a formal breach of the licence agreement), contact eBay.
If you can't sort this out, your only option is to buy Navigator 3 at full price. If you shop around, you can do that for little more than twice the upgrade price.
