Recently on the M1 & M6, in the central reservations of the roadworks (usually by the canteen portakabin), I have seen mobile camera vans. Now, these are not the ones owned by the road safety partnerships, they appear to be owned by the roadworks contractors. I passed one today travelling and on the back it said something along the lines of, camera van keeping our motorway workers safe.
I am wondering what sort of legality these would have, as I am assuming they are not Police force regulated? Would they being doing the same sort of thing as car park enforcement? i.e. Allegedly catch you speeding, apply to DVLA for driver details and send you a fake speeding fine? _________________ Garmin Drivesmart 51 LMT-D Europe |

They seem to be used for checking the speed of site vehicles within the coned off section and unauthorized entry into the coned off area by non-construction vehicles.
There is mention of sending video footage to the Police to give the Police evidence of unauthorized incursion into the coned off area and using the speed evidence to allow employers to take action against speeding drivers of site vehicles. There is no mention of taking action against motorists speeding through the roadworks in the live lanes. _________________ Paul |

I agree, but playing devil's advocate, could these vans (and their operators) be considered similar to Community Speed Watch (CSW)? Where "active members of the community, with the support of the police, monitor speeds of vehicles at specific locations using approved speed detection devices" and registered keepers of vehicles that exceed the speed limit threshold are sent letters advising them of the speed that the vehicle was driven at with the aim of educating them, changing their behaviour and reducing their speed.

Devil's advocate here: I could argue that my smartphone can produce legally enforceable footage - if I film someone committing a crime I can give that footage to the police who could use it to legally enforce the law. It doesn't necessarily mean that fines can be issues solely from the footage.

In the summer I sent some dashcam footage to Sussex police via their link of an idiot overtaking on the hard shoulder then swiftley pulling from there to the fast lane across 3 lanes of traffic.
The auto email I got on submission said that after analysis they may issue a caution, a fine or a court appearance. _________________ DashCam:

I'm guessing that they won't get back with any other details about it due to data protection etc etc. |

Not always. I submitted dashcam footage of someone who came around a bend on the wrong side of the road trying to bypass queuing traffic, and was contacted for more information and asked if I would be willing to go to court. Didn't need to though, in the end they just issued the fine based on the dashcam footage. _________________ Where there's a will ... there's a way. |

Ah, yes, forgot to mention, I did get a reply and it was a caution with his details going on record.
It does seem that dashcam footage is now acceptable but only by some forces. An initiative started by Nextbase it seems. _________________ DashCam:

If I had known I could do that I would have done the same. This happened in Hurst Green north of Hastings and I had to mount the pavement to avoid a head on. The only problem was that it was a police car with no sirens. |

Wow. However legally there is no requirement to use sirens but in this case it seems he wasn't driving in accordance to blue light standards, there is no exemption to cross solid white lines. I once had a motorist stop on the apex of a left hand bend to let me pass, when it was clearly unsafe to do so. Took a minute or so for him to move and I was just about to get out an give him an earful! _________________ Where there's a will ... there's a way. |
