No. It means you must stop, apply the handbrake, switch off the engine, get out and stand in the middle of the live lane, where you may use your hand held phone to your heart's content - even check your emails and the stock market, anything at all. _________________ Dennis

This is where the legislation doesn't keep up with technology, because nowadays, even standalone sat-navs transmit data. Many provide real-time traffic information via 3G (either directly of via WiFi tethering to your phone), which means transmitting as well as receiving data. |

You're taking it out of context, you need to read the whole legislation, not just one part of it. In any case receiving traffic data is what they do, very few satnavs transmit data as defined in the legislation.

Clearly no, he's holding a device that falls under the legislation
However he may be able to if the drive thru isn't deemed to be on the public highway, private land is exempt. _________________ Where there's a will ... there's a way. |

It's nice to have confirmed by the many posts on this topic that my old garmin on its easily reached suction mount is ok to use , and using the cars built in hands free (via bluetooth) to my paired phone in my coat pocket on the back seat of the car is ok, but, speaking somewhat frivolously here, what if an app came out to change the operation of a smart phone in to a hand held press to talk device? that is, you pressed and held the on screen? button to speak, reception being cut off until the buitton was released, when it reverted to a receive only state. Would it then be exempt from the legislation? or, as I suspect, would it only be exempt if it was constructed to be a two way only device with no other function? Discuss? |
