Mr Wright Turns Out To Be Mr Wrong

An innocent man has not only been banned from driving, but also lost his job as a result of a speeding taxi driver who twice gave a false name after being captured on two occasions by speed cameras in Redruth, Cornwall.

The fictitious name that the taxi driver chose was Martin Wright - he also made up a date of birth. Consequently, the police traced a Mr Wright who happened to match the details given and prosecuted him in his absence.

Mr Wright was mistakenly disqualified from driving and fined £1,440. To add insult to injury, he was them sacked from his job at a scaffolding company as a result of the reported offences.

The taxi driver, 46 year old Andrew Gorman, who employed eight others drivers, was sentenced to eight months in prison and received a driving ban for six months.

When sentencing, the Judge at Plymouth Crown Court commented: "This is a consequence you should have expected. The consequences went on to seriously affect the life of an innocent member of the public. He was involved in a fight to clear his name for something you chose to do."

That'll teach him then, a ban of 6 months. Should be 6 years, a re-test and amputation of a body part.
Doesn't go anywhere near a sense of justice for the guy losing his job etc.

I really hope that Mr Wright finds himself the best lawyer he can, and takes that sh*t-house taxi driver to the cleaners, taking him for everything he's got in compensation for loss of job, loss of earnings, personal distress, and whatever else he can think of. And I hope whatever local authority it is that issued his private hire licence take it off him and never give it back. What a low-life.

Edit : thinking about it, he may well also have grounds for a claim against the local rozzers and the CPS as well. Might as well explore all the avenues![/i]

Struggling to see how this even happened. Assuming the taxi driver was speeding in his taxi (?) surely the reg number would have flagged up the correct name and address? Or was he able to register the taxi with Mr Wrights name and address also Confused

Not nessaseraly the taxi would be registered to his company not him.
I was caught in my van not long ago and even though the van is mine it's registered in my companies name so 2 lots of forms to fill out. Both going to the same address.
So the reg wouldn't really Flag the owner only the registered keeper

It's very easy to do. Just look at Motability, they have approx 660,000 cars on their fleet and they are all registered to Motability as the owner but the registered keeper is whoever has the contract with them.

It is the same with any lease company.

I'm confused as usual.
Just as a matter of interest, how do you register ownership of a vehicle?
The usual registration document names the registered keeper.

Well I've just googled around and the situation seems nuts. There is no such thing as a registered owner, all you have is the various receipts, order forms, and correspondence that accompanied the purchase of the vehicle. Effectively it seems registered keeper is just an administrative way of locating the vehicle.

Well, that's what I thought. But people mentioning 'registered owner' got me confused. So it isn't 'very easy to do' at all.

So if your vehicle is photographed 'transgressing' the registered keeper gets a letter asking who was driving at the date and time. Then whoever is named gets a penalty notice, if not paid it proceeds to court via summons, if the summons is not served or the person does not attend court, a warrant is issued, this goes on the police national computer so the person gets nicked if they ever have their details checked. The whole thing is just an administrative procedure with no fact checking at any stage - I assume somebody could even be convicted in their absence?
