|

Does anybody know if A European Company needs to comply with UK trade description law on their web site?
I refer to Tom Tom and their 1K accessories showing a picture of the Home Charger with a USB cable when I find out it doesn’t come with a cable and the Car Charger that states under “in the box” a USB cable when again it doesn’t come with any such cable.
Also as an aside, has anyone noticed a complete decline in the Support function at Tom Tom. I am getting replies in broken English and some cases not even referring to my question but someone else’s query. It would appear the whole thing is falling apart!

What did you get with your GO 1000? They should ship with a USB cable and the cigarette lighter/USB dongle. Some early units shipped with a separate USb cable and a cigarette charger power lead. _________________ Darren Griffin |

I pointed out the error in their web site to TomTom the very day it was launched so they certainly knew about it, send them an e-mail asking why your device didn't have the full contents in the box as detailed on their own web site and wait for a reply - Mike |

It might be a good idea to take a screen print of the TomTom website as proof. Just in case they change it!

No Boys - this refers to the accessories ! Not the shipped contents.
The accessories details are just misleading.
Just look at "compatible accessories" it's just plain wrong !! |

It's all a mess, the mains charger they show is the generic charger for the devices that support mini-USB.
The car charger states mini-USB cable supplied when, for the 1K I'm not sure if they supply a compatible cable or you just get the charger plug itself.
I'll mention this to them and see what they have to say. _________________ Darren Griffin |

No, you get no USB, just the car charger plug!
That's what I mean about Trade Description Law. Does it apply to all Countries within the EU |

Nope, UK law is still just that, UK law. Even here, there is the E&OE exemption. They can simply claim it is an error, as it almost certainly is.
You are covered by the distance selling legislation though so you can return any item for a full refund.
Have you actually bought any of these items? _________________ Darren Griffin |

I commented on the issue of no separate cable for home usage. Can't even see the G100x to USB cable on the accessories list as yet either
I recall your posts when we slated this device and yet here you are with MyTomTomHome issues and complaining about the lack of a cable for home use.
Perhaps we had a point after all _________________ Darren Griffin |

The item you want is available its just not easy to find, click Here for the USB cable.
I wouldn't bother if I were you, even with a schedule for release of functionality that it should have had from day 01, there is no way these dates will be met IMHO and even IF they manage to meet the dates the device is still less capable than the entry level Start which costs three times less! - Mike |

If you enter into a contract with a third party then you can choose which jurisdiction you want the contract to be formed under, eg England and Wales. The other party may choose not to enter into the contract on that basis though so this is a difficult road to go down.
That said, you will find that pretty much all EU countries have similar consumer protection laws to England and Wales. Certainly the "Distance Selling Regulations" that Darren points out are the result of Directive 97/7/EC and they will be implemented in one form or another by all EU member states.
Directive 97/7/EC requires the "Provision of comprehensive information before the purchase". It would be fundamental for this to contain a detailed and accurate description of the goods to be supplied. Certainly, a vendor would be bang to rights if they gave a description which was not accurate. _________________ Gone fishing! |

It's all rather moot in this case, Mow hasn't bought anything and even if he had, Distance Selling would have covered him.
What we have is some poor management of the web shop and descriptions. It's an error or oversight, nothing more. _________________ Darren Griffin |

Indeed, I've raised this faux pas with them directly, will be interesting to see how long it takes them to correct or even 'if' they do at all _________________ Darren Griffin |
