Crying or Very sad Can anyone help, i have been sent a summons for speeding, yet i know i havent, i have the GPS logs for the entire journey but need to pinpoint the exact GPS location of the mobile camera that it based in the southwest.

The address given by the police id: The Lake, near sourton, Devon, but i cannot find the exact spot, if anyone can help i would be gratefull.

GPS data for the whole days trips show i was under the speed limit from okehampton to tavistock and back, but as the road speeds along this part change considerably from 30 to 60 to 40 etc many times i just need to know if anyone can help pinpoint the possible location so i can remap it onto google earth with the track logs and prove my point.

I am due in court on the 23/2/2010 and have only managed to retrieve the data after having it sent back from garmin after the last 660 screen failed.

Do you know which road this was on? Also does the NIP state what type of camera it was i.e. a Handheld, fixed camera etc?

a quick search on the submission map for 'sourton, devon' shows a 'lake' (bit of water) by sourton so presume this could be the road. just south on the A386 is MOBILE:24447@40 (currently 'inactive' due to not receiving seen again reports)and just north on the A30 is MOBILE:52429@70

maybe that is some help?

You beat me too it. Searching using "the Lake, near sourton, Devon" brings up that exact location.

So we can assume it is a 50mph handheld mobile camera. If you search on 50.68097,-4.0848 into Google or better still, our submission map here you will get the location.

What speed does the NIP allege you were doing and what does the log say?

well if i can pinpoint the exact place my speed apparently was 54mph but my logs say that between 2 points where i think he was hiding was between 38.14 and 40.08 mph

The bigger issue now is that the court is highly unlikely to accept your log data as evidence.

In what format is it (the logs) currently? And are you planning on representing yourself?

I'd suggest you pop over to www.pepipoo.com and explain the situation, i.e. you have log data that suggests you weren't speeding etc and see what they suggest. There are legal experts there who can advise you on the best course of action.

Thanks the position of the camera is MOBILE:24447@40, the format of the garmin logs are in GPX format i used visualgps to overlay the tracks onto google earth and they also provided a printout of some 1000 tracks with speed, distance lang and lat, time and date. What i dont understand is why a court will not accept these as evidence ??, i use this unit for flying so i know this unit is accurate.

At a guess, I suspect its because the evidence from the unit could be faked or doctored. Unless it was tamper proof I can't see a court accepting it.

Quite. The evidence will not be accepted without an expert to present it. The logs could be easily faked so it would require an expert to give evidence stating that the logs were the same as the data within the unit and how that data could not be tampered with (if it couldn't) or how difficult it would be to do so etc etc.

You can submit it but I wouldn't hold out much hope that they will choose to believe that over the evidence from the laser.

You need to read and understand what a Chain of custody is.

If an independant third party downloaded the data from the GPS, established a chain of custody and is willing to act as an expert witness then you may get it admitted as evidence.

Be aware that they may take the entire tracklog off you and it could show that although your speed over the section where you were nicked was OK that your mate who borrowed your GPS on another occasion Wink Wink did some naughty driving.

Also remember that the Garmin GPS tracklog is an AVERAGE over many seconds whereas the LASER takes an instantaneous reading from your vehicle so the log may get shot down for this.

The good folks on the pepipoo website are probably your best bet. Good luck.
