Continous RED LED on my Bluetooth TomTom unit

I purchased a Tom Tom Navigator Bluetooth version with the silver bluetooth tomtom unit.

Set everything up ok, the unit was just finding its first fix which it did.

However, when I came back to the unit it has a continous red led where the bluetooth light was. I am also unable to turn the unit off by pressing the power button.

I do not know if it makes a difference but I did not charge the unit before I tried to do the first fix.

Is the battery dead or is it a bigger problem.
