I have upgraded to the new "Maps of Western Europe" and was thinking of selling my old maps (4 x CD set). Is this possible or do TomTom not allow you to sell it on?

The real question is if they will allow the new owner to register it with their TomTom product code?

I would have thought it wouldn't work because the New maps are tied into your Old map registration.

It would also be frowned on by TomTom as the upgrade would be seen as a part of your total map purchase.

I would have thought that they are two seperate items, purchased seperately, invoiced seperately. The Upgrade is offered at a lower (special) price to reflect the fact that I have been a loyal customer and already purchased their previous product which has now been superceded. It would be interesting to know where they stand with trading laws in the UK if they restrict my right to sell this product

I think that TomTom's view is that you have NOT bought a product. You have only bought the right to use the product.

It does mean that if you break a CD then TomTom have to replace it at a nominal cost so that you have continued use of the right to use the maps.

I would assume it is the same as a Microsoft/Norton piece of software.

If and when I upgrade my Norton Antivirus each year, I have the option of buying either the upgrade version for a cheaper price or the full stand alone version for the full price. If I buy the upgrade, it can only be installed provided an earlier version is on my computer and the License makes the upgrade a part of the original software. If I buy the stand alone version, it is not tied up with any previous software, so I can sell the original to anyone.

On that basis, the upgraded maps are not dependent on you having a previous set on your TomTom, it appears that TomTom are just rewarding you for being a previous customer.

Hi.. I would agree with TheGas and the other comments here. From what you say, you have got the new maps as part of an 'upgrade' deal and price because of this. This 'upgrade' gives you a new license to run the package you have, of which includes the original maps also.... Dave

Tom Tom have made this clear to a user, posted I think on "mytomtomgo" forum. there response was " you have bought the right to use the software only, any sale to a third party would be regarded as piracy.

AFAIK The product code used to qualify for an upgrade is blocked by TomTom from generating an activation code, effectively preventing that old product from being used on another device. The original owner can of course still reinstall it, if a record of the activation code has been kept.

This is why you shouldn't buy pre-owned maps.

I have been trying to read the licence that came with my Upgrade -- unfortunately the microscope lamp has broken so I cant read it....


Interesting point though if they make the print so fine that you cant read it is it deemed to be contractually binding??
