Ohio Residents Sue Over Speed Camera Tickets
Article by: rob brady Date: 16 Oct 2013
The residents of the village of Lucas, in Ohio are suing their village authorities over what they believe to be unfair processes relating to the use of speed cameras.
More than 60 people who received $100 fines are involved in the action and seven lawyers who were separately approached by clients have combined their resources into a single class-action lawsuit.
They are citing lack of due process by the village, claiming that it did not follow state public notice requirements. They also say that the rules governing Ohio Mayor's courts were not followed. Some of the drivers are claiming that they weren't even speeding.
Lawyer, Cassandra Mayer stated, "There is no indication as to how these cameras are kept up or how they are calibrated," adding that the system makes it difficult to appeal the fines.
The village denies malpractice saying that the action doesn't have any legal standing. However Mayer said this lawsuit is similar to a previous one against a Cincinnati village earlier this year, which led to a judge's order against speed camera use.
