Is it correct that when you 'Terminate' the app still appears in the list of recent apps when you double click the Home button?

Yes. That list is not exactly a list of running apps, it's closer to a 'recently used' list albeit it maintains a very long list and also contains apps that are running in the background.

An app can of course be killed from the multi-tasking apps list and removed from that list, but it's presence there does not mean it is running or consuming resources (although it could be).

Confusing eh? You can be sure it is not running as the GPS arrow is not present in the menu bar.

i really wish they'd add 1 of 2 icons to each app in the task bar. eg a little clock or 'Zzz' for apps that are 'frozen' i.e. only 'ready' for fast-app switching but aren't actually running as such. then another, a cog maybe, to show apps that are actually still running in the background (even better would be one or more of 4 icons to signify WHAT service is running: task completion, location, voip, audio). anything without an icon you would know was just a shortcut to a recently used app.

I've updated the firmware to 4.1 and as you suggested this has fixed to return from fade issue. Thanks. I still have a minor issue in that it makes no difference if its on pause or fade both options just fade. This only occurs when its in the car plugged into the Radio Accessory so not sure if this is the culprete. Any ideas how I can test further TomTom works but this is also fade so I need an app (ideally free) that also pauses the iPod music for some form of alert.

how do you have it connected? bluetooth? cable from headphone socket? dock connection?

The iPhone connects via a dock into the ICE system, the iPod controls are made via the Head Unit or steering wheel.

I've just connected some speakers via headphone socket and bluetooth, testing with Cameralert the sound pauses and fades but its not connected to the dock as soon as its docked all control and audio is handled by the ICE.

I hadn't noticed if the previous version paused or not, all I know is the audio didn't return to the correct level.
