Given that ITIS using a floating set of sensors in X fleet operated trucks etc how do they know that a road has been closed once there is no one on it. The scenario in mind:
M4 closes - a large number of cars and lorries are trapped on it - lots of sensors showing zero motion - thus it will be reported.
Police clear the backlog - turning people around etc - Motorway is now clear but still closed resulting in no signals - the M4 now looks like there is no issue as no one is reporting any stoppages

Am I missing something here (like ITIS have another source of information) or is this a fundimental flaw?

The Floating Vehicle Data (FVD) is just one of the data sources. They also use data from Highways Agency and other data providers.

ah ha - I wonder why people seem to rail at the "fact" that they fail to report some road closures then! Ah well some info is better than none. Now all I need to do is solve the reception issues by following some of the advice on this excellent forum

A few weeks ago they were correctly reporting a section of the A92 as being closed.

It was closed for for four weeks. Unfortunately iTIS were still reporting it closed for at least 2 days after it re-opened.
