I'm not sure you could claim a refund on the basis of fitness for purpose. The device is designed for satellite navigation and presumably the TT 1000 actually does do that; I would suggest the non-enabled functionality would be irrelevant to such a claim.

Perhaps you could return it under the Distance Selling Regulations?

Distance Selling is sufficient to permit you to return but can you not just cancel the order now if it has not been fulfilled?
