My setting has always been set to pause, I can try pade on my journey home tho see if it produces the same issue. as far as my phone is concerned its a 3GS on ios 4.0.1

yep youve got it, unfortunately if you charge on my dock (which you need to to keep running the app) all audio will be routed through the fm transmitter which is rarely used - for me anyway!
